Hochuli Design & Remodeling Team ("Company," "we," "us," or "our") provides this website and the tools and content on it. These Terms of Service ("Terms") govern your access to and use of our website (the "Site") and any related online features and services (the "Services"). By accessing or using the Site, you agree to these Terms.

Please note: These Terms govern your use of our website only. They are separate from, and do not replace, any written remodeling agreement or Project Development Agreement you may sign with us for a remodeling project. Using this Site does not create a client relationship. That relationship begins only when both parties sign a written agreement.

Your use of the Site is also governed by our Privacy Policy, which explains how we handle personal information. Please read these Terms carefully. If you do not agree with them, please do not use the Site.

1. Acceptance of These Terms

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not access or use the Site.

We may revise these Terms from time to time. The "Effective Date" and "Last Updated" dates above show when these Terms were most recently changed. Your continued use of the Site after we post an update means you accept the revised Terms.

2. Who We Are and What This Site Is For

Hochuli Design & Remodeling Team is a design-build remodeling company serving the greater Phoenix metro area. We hold Arizona ROC license 173428.

This Site exists to share information about our company and services, to provide educational content about remodeling, to display photography of our completed projects, to offer online estimator tools, and to make it easy to reach us and schedule a conversation. The Site is intended for general informational purposes and to help homeowners learn about the remodeling process.

Nothing on the Site is an offer to enter into a remodeling project or a commitment to perform work. Any project relationship is created only through a separate written agreement signed by both parties.

3. Permitted Use and Restrictions

You may use the Site for lawful, personal, non-commercial purposes to learn about our company and services and to contact us. When you use the Site, you agree that you will not:

  • Use the Site in any way that violates any applicable law or regulation.
  • Copy, reproduce, republish, distribute, or create derivative works from any content on the Site without our prior written permission.
  • Use any robot, scraper, or automated process to access, collect, or harvest content or data from the Site.
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks.
  • Interfere with or disrupt the operation of the Site, including by introducing viruses or other harmful code.
  • Provide false, misleading, or fraudulent information through any form or tool on the Site.
  • Reverse engineer, decompile, or attempt to derive the source code of any tool, estimator, or software on the Site.
  • Use the Site or its content to develop or train any machine learning or artificial intelligence system without our prior written permission.

We may suspend or restrict access to the Site, in whole or in part, at any time and without notice, for any reason permitted by law.

4. Intellectual Property

Unless noted otherwise, all content on the Site, including text, articles, guides, graphics, logos, page design and layout, photography, video, estimator tools, and underlying code, is owned by or licensed to the Company and is protected by United States copyright, trademark, and other intellectual property laws.

Project photography

Photographs and videos of our completed projects shown on the Site are our property. You may not download, copy, or reuse them for any purpose without our prior written permission.

Crush Expectations

References on the Site to the book Crush Expectations, authored by Scott Hochuli, are provided for informational purposes. The book and its contents are protected by copyright. Nothing on the Site grants you any right to reproduce, distribute, or create derivative works from the book.

Limited license

We grant you a limited, revocable, non-transferable license to view and to print individual pages of the Site for your own personal, non-commercial reference. Any other use requires our prior written permission. Our company name, logo, and marks may not be used without our written consent.

5. Online Estimators and Pricing

The Site offers online estimator tools that produce a preliminary investment range based on the information you provide and general market data.

Estimator outputs are preliminary planning ranges only. They are not quotes, bids, proposals, or offers, and they do not create a remodeling agreement or any binding commitment. They are provided to help you plan and to give a realistic starting point for a conversation.

Actual project pricing depends on your specific scope, selections, site conditions, and other factors that cannot be assessed through an online tool. Pricing is confirmed only through our paid Project Development Agreement, after we evaluate your project in detail. Estimator ranges, pricing information, and any figures shown on the Site may change at any time and are not a binding price.

6. Educational Content Is Not Professional Advice

Articles, guides, checklists, frequently asked questions, and other educational content on the Site are provided for general information. This content is not professional design, construction, engineering, or legal advice, and you should not rely on it as such for your specific project or situation.

Building codes, permitting requirements, product availability, and site conditions vary and change over time. For advice specific to your project, consult a qualified professional. Reading content on the Site does not create a professional, advisory, or client relationship.

7. Third-Party Links

The Site may contain links to third-party websites and resources, such as financing partners, review platforms, and suppliers, provided for your convenience. We do not control these third parties and are not responsible for their content, products, services, or privacy and data practices.

A link does not mean we endorse the linked site. Your use of any third-party site is at your own risk and is governed by that site's own terms and privacy policy.

8. Testimonials and Reviews

Reviews, testimonials, and client stories on the Site reflect the individual experiences and opinions of specific clients. They are shared with permission and are not a guarantee of any particular result.

Individual results vary based on project scope, selections, site conditions, timing, and many other factors. A testimonial about one project should not be read as a promise about the outcome of yours.

9. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Site will be uninterrupted, secure, or without error, that content is complete, current, or accurate, or that any estimator output will match actual project pricing.

This disclaimer applies to the website only. It is separate from, and does not limit, the written warranty we provide for completed remodeling work performed under a signed remodeling agreement.

10. Limitation of Liability

To the fullest extent permitted by law, the Company and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your access to or use of, or inability to use, the Site or your reliance on any content on it.

To the fullest extent permitted by law, our total liability arising out of or related to the Site and these Terms will not exceed one hundred dollars (US $100).

This limitation applies to the Site only. It does not affect, limit, or replace any rights or obligations under a signed remodeling agreement between you and the Company.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owners, employees, and agents from and against any claims, damages, losses, liabilities, and costs, including reasonable attorneys' fees, arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

12. Governing Law, Venue, and General Provisions

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction and venue of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will stay in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms are the entire agreement between you and the Company regarding your use of the Site, and they are separate from any remodeling agreement.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms. We encourage you to review these Terms periodically.
